Law SB 854 FACT SHEET

The Tiburon Fire Protection District (“District”) procures goods and services from suppliers in the local area as well as statewide, regionally, nationwide and, in rare cases, internationally. The District also enters into contracts with a wide variety of businesses and individuals for a broad spectrum of products and services. All procurement is governed by the District’s commitment to quality, cost effectiveness, efficiency and fairness in a competitive arena as well as adherence to applicable statutes, rules and regulations; the integrity of its procurement process is of utmost importance.

NEW PUBLIC WORKS CONTRACTOR REGISTRATION LAW (SB 854)

As per the Department of Industrial Relations requirements, as of April 1, 2015, the District may only award Public Works projects to contractors/subcontractors that are in compliance with the new Public Works Contractor Registration Law (SB 854).

Public Works are defined as projects involving any work done under contract and paid for in whole or in part out of public funds – except work done directly by any public utility company pursuant to order of the Public Utilities Commission or other public authority – in the following categories:

  • Alteration
  • Construction
  • Demolition
  • Installation
  • Maintenance
  • Repair

Contractors/subcontractors doing Public Works projects must register and meet requirements using the online application before bidding on Public Works contracts in California. The application also provides agencies that administer Public Works programs with a searchable database of qualified contractors/subcontractors. More information is available at the following link:

PREVAILING WAGE

If the cost for any Public Works project is expected to exceed $1,000.00, per the California Department of Labor Standards Enforcement (DLSE), Prevailing Wage Law shall apply. The District encourages every contractor/subcontractor to visit the following links for more information on Prevailing Wage Law requirements:

Notice Inviting Interested Contractors for the 2022-23 Informal Bid List

In accordance with the State of California Uniform Public Construction Cost Accounting Commission, the Tiburon Fire Protection District is inviting all interested licensed contractors to submit their company for inclusion on the District’s Informal Bidding Contractors List for 2022-23.

Companies must resubmit to be included on the 2022-23 list even if your company has submitted an application in prior years.

Per California Public Contract Code 22032, any Public Works Project that is estimated to be below $175,000 is subject to the Informal Bidding Procedures set forth by the State of California Uniform Construction Cost Accounting Commission. All trade categories are subject to Informal Bidding Procedures.

Contractors who are interested in being on the 2021-22 Informal Bidding Contractors List are required to have a current license and are subject to verification through the Contractors State License Board.

Additionally, pursuant to SB 854, no contractor or subcontractor may be listed on a bid for a public works project (submitted on or after March 1, 2015) unless registered with the Department of Industrial Relations (DIR) and no contractor or subcontractor may be awarded a contract for a public works project (awarded on or after April 1, 2015) unless registered with the DIR per California Labor Code section 1725.5.  http://www.dir.ca.gov/Public-Works/PublicWorks.html

If you or your company would like to be placed on the Tiburon Fire Protection District Informal Bidding Contractors List, please provide your company’s name and mailing address to which a Notice to Contractors or Proposal should be mailed, a phone number at which the contractor may be reached, the type of work in which the contractor is interested and currently licensed to do together with the class of contractor’s licenses(s) held and contractor license number(s).
